USA: Biodegradable plastic container labeling law enacted in Alabama

16 April 2014

Alabama has become the second US state to require that degradable, biodegradable or compostable rigid plastic containers be identified as not recyclable when it enacted SB 284. According to the bill’s sponsors, the measure is expected to reduce contamination of plastic recycling streams.
Under Act No. 2014-135, rigid plastic containers that feature any of the three aforementioned terms must also display the message “Not Recyclable, Do Not Recycle” in prescribed typography. Such rigid plastic containers must also comply with the US Federal Trade Commission's Guides for the Use of Environmental Marketing Claims. The Act takes effect on July 1, 2015 (State Recycling Laws Update, 4 April 2014).
